Seltice Systems LLC provides shared web hosting to many clients and has a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure that these obligations are met.

Content

All services provided by Seltice Systems LLC may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to, copyrighted material, material we judge to be threatening or obscene or material protected by trade secret or other statute. The subscriber agrees to indemnify and hold harmless Seltice Systems LLC from any claims resulting from the use of the service that damages the subscriber or any other party.

The views and information provided by websites or blogs hosted by Seltice Systems LLC are not the views or feelings of Seltice Systems LLC. The website owners and content providers are solely responsible for the data, information, images, etc, that they put on their own websites. Seltice Systems LLC does not consistently monitor all the information posted to the websites we host.

All pornographic content and sex-related merchandising is prohibited on all Seltice Systems LLC servers. This includes sites that may infer sexual content or links to adult content elsewhere. Seltice Systems LLC will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Seltice Systems LLC servers or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content, links and/or use:

• Pirated software
• Hacker programs or archives
• Warez sites
• Sending of Unsolicited email
• IRC bots or software
• Pornography
• Virus infected software or email
• Violating U.S. export restrictions
• Threats
• Stalking
• Illegal activity
• Theft
• Sharing copyrighted MP3, music or video files
• Violation of the DMCA
• Copyright infringement of any kind

Seltice Systems LLC will be the sole arbiter as to what constitutes a violation of this provision.

Background Checking

Seltice Systems LLC maintains the right to do a background check on any potential or existing client. We may contact past hosting providers to verify that your domain has not been associated with SPAM or other forms of abuse or illegal activity.

We always reserve the right to refuse business, and to terminate services for any domain at any time without notice if they violate this terms of service agreement.

Viruses, Spam and E-Mail problems

E-mail is not a perfect technology. Some emails may get lost, filtered or blocked by some means along the way from the sender to the receiver. Seltice Systems LLC can NOT be held liable for any loss of email either in the process of reaching you from a sender, or reaching your intended email recipient from Seltice Systems LLC servers.

In the case of a wide spread email virus, Seltice Systems LLC reserves the right to block all incoming emails that meet certain criteria, such as emails with attachments containing certain extensions, or emails between a byte range, or emails from a particular source.

It is possible that Internet service providers will block our mail server because of abuse or disregard for their terms of service. Seltice Systems LLC can NOT be held liable for email problems or delivery problems due to another ISP blocking our server.

It is your responsibilty to follow up with the intended email recipient by some other means to verify that they received your email correctly. This is especially true if an email is important, or time sensitive.

Seltice Systems LLC offers specialty Spam Filters and Email Quarantine software for upgraded accounts at an additional fee. If these services are turned on for your domain for any reason, you agree to understanding the risk. The risk is that important emails may be deleted, blocked or filtered before they reach you. This may cause the loss of email. Seltice Systems LLC can NOT be held liable for the loss of email due to Spam filters or Quarantine. (The Spam filter on Seltice Systems LLC servers is SpamGuard). It is your responsibility to use these tools correctly and to verify that you are not filtering important emails.

Seltice Systems LLC reserves the right to turn on the SpamGuard or Quarantine software on any domain with or without permission from the account holder. This is only to protect the integrity and stability of our servers.

Seltice Systems LLC is never liable or responsible for viruses or spam and the problems that result from accessing such emails. The Client is solely responsible for protecting their own computers from harm.

E-Mail Commercial Advertising and E-Mail Mailing Lists

Spamming, or the sending of unsolicited e-mail, from an Seltice Systems LLC server or using an e-mail address or domain that is maintained on an Seltice Systems LLC machine as reference is STRICTLY prohibited. Seltice Systems LLC will be the sole arbiter as to what constitutes a violation of this provision.

If Seltice Systems LLC receives notifications from recipients of our customers' mailing lists or emails that our hosting customers are sending Spam or are not conforming to the CAN-SPAM ACT we reserve the right to terminate our hosting customer accounts immediately.

E-Mail mailing lists must be less than 2000 recipients to avoid termination of your account. No account may send more than 2000 emails per day. Alternate email services should be found if your list is to exceed 2000 recipients.

Server Use

Seltice Systems LLC reserves the right to suspend or cancel the hosting of any account that uses above average resources. This may include, but is not limited to:

• Sending and receiving large files
• Delivering lengthy video content
• Emailing a large number of addresses
• Running scripts or software that use system memory, disk space, or cpu cycles
• DDoS attacks on your domain name or email system

IRC

IRC or IRC bots may not be operated on our servers at this time.

Liability

If for any reason, your website becomes inaccessible, damaged or otherwise unusable, Seltice Systems LLC is not liable for any damages, loss if income, wages or customers due to these problems.

The customer is solely responsible for all material on their website. We do offer backups, but these backups are for emergency purposes only and in the case that changes were made to your website or email between backups, the information between the time of loss and the last backup may be lost.

We will not tolerate any unacceptable uses of our servers and will terminate accounts at will and at our own sole discression if we believe your account is being used in any way that may conflict with this agreement.

The client is responsible for their own website content. If the content is lost, it is the sole responsibility of the client to restore the lost content.

If data is lost and cannot be recovered. Seltice Systems LLC will attempt to recover lost data from our own archives, but we do not guarantee that your files will be recovered. We consider this a "last resort".

We may modify this agreement at anytime with or without notifying the clients and customers. If the client violates this agreement in any way, at anytime, Seltice Systems LLC reserves the right to completely remove the account from our systems.

Billing

All web hosting services and domain name registrations are non-refundable.

Full payment must be made before services are rendered.

Web hosting is not website design, and is stated as such in a contract which must be signed and approved before website development begins.

If payment is not made prior to services being rendered, your website may be suspended with or without notice, then 30 days thereafter, your domain name will be deleted.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of Seltice Systems LLC is strictly prohibited.

If you exceed your bandwidth, disk space or email quotas, additional fees will apply.

Refusal of Service

We reserve the right to refuse, cancel or suspend service based on any violation of the above stated policy and guidelines.

All Sub-Networks, distributive hosting sites and dedicated servers of Seltice Systems LLC must adhere to the above policies.

Access

You are required to make any and all arrangements to access your website, email and other hosting services of Seltice Systems LLC. You are responsible for all 3rd party fees required to access the Internet, own and/or use a computer and to access your website and email in general. Additional 3rd party costs and fees will apply to access the Internet and your website.

Failure to follow any term or condition will be grounds for immediate account deactivation.
